Public Procurement Law

Public procurement law governs the contractual relationship between public authorities and market actors that provide goods and services required by public entities in order to carry out their mandates. While certain types of tenders aim at generating income for the public entity in question, in many cases the subject of a tender is the purchase of goods and services by a purchasing authority, in exchange for payments made to the contractor. Public procurement and tender procedures are used to identify which tenderer which will provide the required goods and services, and receive payments in return.

Public procurement procedures often lead to disputes between the administration and contractors/tenderers. The decisions and actions related to the preparation of tender dossiers, calculation of costs, evaluation of bids and the award of the contract are all prone to possible disputes between these parties.
